Notice is hereby given that Sundance West Condominium Owners Association has proposed a Fourth and Fifth Amendment to its Condominium Declaration for Sundance West Condominiums recorded on June 22, 1981, in Book 294, Page 69 at Reception No. 120870, as amended (the "Fourth and Fifth Amendments"), and according to the Condominium Plat for Sundance West Joint Venture II, recorded on February 19, 1982, in Reception Number 191333 in the Grand County, Colorado real property records (the "Property"). The Fourth Amendment, if approved, proposes regulations for the operation of home-based businesses within the Condominiums, limits short term rentals to no less than 6 months, and prohibits subleasing of Units. The Fifth Amendment, if approved, would change the insurance requirements for the Association to "Bare Walls" coverage and would require homeowners to obtain H06 insurance, or its equivalent if H06 is not available, for their own benefit for full replacement value covering the interior of the Unit.
All First Mortgagees of any unit(s) within the above-described Property are hereby put on notice that they may consent or deny their consent to the Fourth and Fifth Amendment within sixty (60) days after the date of this Notice as set forth below. A first mortgagee that does not deliver a negative response within sixty (60) days after the date of this Notice shall be deemed to have approved the Fourth and Fifth Amendment.
