NOTICE TO MORTGAGEES OF PROPOSED AMENDMENTS TO CONDOMINIUM DECLARATION FOR COLORADO MOUNTAIN CONDOMINIUMS Dated: November 30, 2018 In accordance with Section 38-33.3-217(1)(b) of the Colorado Revised Statues, Colorado Mountain Condominium Association, Inc. (the "Association") hereby gives notice to all holders of first recorded mortgages and deeds of trust ("Mortgagees") encumbering any interest in a condominium unit of Colorado Mountain Condominiums located in the Town of Vail, County of Eagle, State of Colorado. The Association is voting to amend Paragraphs 14 and 17 of the Condominium Declaration for Colorado Mountain Condominiums recorded June 15, 1984, in Book 387 at Page 619 as Reception No. 283921 in the Clerk and Recorder's Office, County of Eagle, State of Colorado, and any and all supplements and amendments thereto (collectively, the "Declaration") in the form of the proposed amendment (the "Proposed Amendment"). Paragraph 17 of the Declaration provides, among other things, that Paragraph 14 of the Declaration may be amended upon approval of seventy five percent (75%) of all Mortgagees, and that Paragraph 17 of the Declaration may be amended upon approval of all Mortgagees, plus certain approval of owners. Mortgagees are thereby entitled to approve or disapprove of the Proposed Amendments. The Association hereby requests that each Mortgagee send its written approval or disapproval of the Proposed Amendments to the Association at the address below within sixty (60) days after the date of this Notice. ANY MORTGAGEE THAT DOES NOT DELIVER TO THE ASSOCIATION A NEGATIVE RESPONSE WITHIN SIXTY (60) DAYS AFTER THE DATE OF THIS NOTICE SHALL BE DEEMED TO HAVE APPROVED THE PROPOSED AMENDMENTS TO THE DECLARATION.
